TERMS OF SALE

The products sold on the www.gianvix.it website (the “Site”) are sold and invoiced by GIANNOTTI VITTORIO E FIGLI SNC with registered office

in Via Lucilio 15, 80132 Napoli, Italy, a company registered with C.C.I.A.A. of Naples, C.F. and P.I. 07028920630 (“Giannotti Vittorio &

Sons”).

For any information regarding orders, shipments and, more generally, purchases, you can access the area

Customer Service where more information is available. For further assistance, do not hesitate to contact the Costumer Care of

Vittorio Giannotti.

GENERAL CONDITIONS OF SALE
1. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE AND CONCLUSION OF THE CONTRACT
1.1 Giannotti Vittorio & Figli snc offers for sale on the Website www.gianvix.it products to end consumers, that is, to subjects

adults who purchase for purposes not related to their commercial, entrepreneurial or professional activity,

possibly carried out (the “Customer”). Giannotti Vittorio & Figli snc therefore reserves the right not to process orders

coming from subjects other than the “Customer”.

1.2 The contract stipulated between Giannotti Vittorio & Figli snc (hereinafter also the “Seller”) and the Customer must be considered concluded

with the acceptance, even if only partial, of the order by Giannotti Vittorio & Figli snc. In the case of non-acceptance,

Giannotti Vittorio & Figli snc will promptly notify the Customer.

1.3 By placing an order in the various ways provided, according to the order form on the Site (hereinafter, the “Order”), the

Customer will have to read all the information provided to him during the purchase procedure and fully accept the

present general conditions (hereinafter the “Conditions”).

1.4 These Conditions may be printed or saved on a durable digital medium, in compliance with the provisions of art.

12 of Legislative Decree 70/2003 and by art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

2. METHOD OF PURCHASE
2.1 The products offered for sale by Giannotti Vittorio & Figli snc are only those present on the Site at the time of forwarding

of the Order, as described in the relevant information sheets.
In any case, it is understood that the images accompanying the description of a product are for informational purposes only and

may not be perfectly representative of its features, but differ – for example – in color and size (also in

reason for the browser and monitor used for accessing the site and viewing images).

2.2 The Customer, to place an Order, must complete in its entirety the relevant form on the Site and send it following the

instructions on the Site itself, after carefully reviewing these Terms and the characteristics of the product

and / or the products that it intends to purchase, the relative price (including all applicable taxes or duties) and the costs of

shipping (including any additional costs to be incurred for choosing a type of shipping and delivery more

rapid and / or different from the standard one). The Customer may request an invoice from Customer Service after receiving the email from

shipping confirmation only if at the time of purchase you clicked on “Do you want to request an invoice?” and entered the code

tax.

2.3 Giannotti Vittorio & Figli snc will confirm the correct receipt of the Order by reply via e-mail, sent

to the e-mail address communicated by the Customer. This confirmation message will briefly contain the information on the

Right of Withdrawal as well as a link that refers to the General Conditions of Sale. It will also report all commercial information and

contractual terms examined before placing the Order (the main features of the product, the information details on the price, i

payment terms, return methods and shipping costs) so as to allow the Customer to review them

information.

2.4 Giannotti Vittorio & Figli snc may not be able to process Orders that are incomplete or inaccurate or in

case of unavailability of products. In such cases, Giannotti Vittorio & Figli snc will inform the Customer of the failure to conclude the

contract, specifying the reasons.
If the products on sale on the Site are no longer available at the time of receipt of the Order by the Seller, the

Seller itself will inform the Customer as soon as possible.
In the event of an order concluded and the price already paid for a product that is no longer available, the Seller will reimburse the product

Customer, without undue delay, the amount paid and the contract concluded between the parties will be considered terminated.

3. PRICES AND PAYMENT METHODS
3.1 The prices indicated on the Site are to be considered inclusive of taxes and VAT. Any shipping costs or expenses

payment are in any case communicated in advance to the Customer through the Site.

3.2 Purchases can only be made by credit card or debit card, with PayPal or with other methods

possibly indicated on the Site, case by case (such as the Payment on Delivery for which additional costs are provided).

3.3 In case of payment by credit or debit card, financial information (such as, for example, the

card number and / or expiry date) will be sent via encrypted protocol to UNICREDIT or to another institution

banking, which provides the related electronic payment services at a distance, without third parties being able to know them in any way. These

information will also be used by the Seller solely to follow up the purchase or for a possible refund procedure

in case of return, following the exercise of the right of withdrawal or to report to the police the possible

fraud commission.

3.4 In no case and at any stage of the payment Giannotti Vittorio & Figli snc will be able to know the relative information

to the Customer’s credit cards, which will be directly transmitted via a secure connection to the bank’s website

manages the transaction. Giannotti Vittorio & Figli snc will not store such data in any electronic archive and therefore in no one

In this case, it may be held liable for any fraudulent or improper use of credit cards by third parties at the time of

payment.

3.5 The price of the products on sale and the shipping and delivery costs indicated on the form for the Order, will be charged to the

Customer when ordering. In case of payment in cash (if the payment on delivery service is active), the price

must be paid upon delivery.

4. DELIVERY OF PRODUCTS AND SHIPPING COSTS
4.1 The purchased products will be delivered to the address indicated by the Customer in the Order, by Giannotti Vittorio & Figli

snc and its logistics service providers, at the cost specifically indicated on the Site before sending the Order.

4.2 The delivery times of the products may also vary with respect to those entered on the site, for reasons not attributable to Giannotti

Vittorio & Figli snc cannot be obviated by it. Upon delivery of the products, the Customer is required to sign the bill of

delivery after having duly checked:

4.2.1 that the number of packages delivered corresponds to what is indicated in the transport document.

4.2.2 that the packaging is intact, not damaged or wet or otherwise altered, even in the closing materials (adhesive tape or

metal straps).

4.3 Any damage to the packaging and / or the product or the mismatch in the number of packages or indications will have to

be immediately detected, by placing a specific indication on the delivery document of the product to be returned to

Courier service.

4.4 Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported

within 7 days of delivery to allow Giannotti Vittorio & Figli snc to proceed with the appropriate checks. How much

above in any case it does not affect in any way the right of return or the legal guarantee on the product.

4.5 The purchased products are provided with an identification tag necessary in case of return of the goods.

5. RIGHT OF WITHDRAWAL AND RETURN
5.1 The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide reasons and without

no penalty, within 14 (fourteen) days from the date of delivery of the products.

5.2 To exercise the right of withdrawal referred to in paragraph 5.1 above, the Customer must use the appropriate form available at

following link return form, or use the paper return form.

5.3 In case of withdrawal, the Customer must return the products to Giannotti Vittorio & Figli snc within 14 (fourteen) days from

same withdrawal, according to the following procedure: sending the product / products being returned to the address indicated in the Form

Returned by selected courier and charged directly by the Customer (the Customer will bear all shipping costs);

5.4 The goods must be returned intact, together with the original packaging (including any accessories, labels, tags,

tags, seals, etc.) and possibly used for the time strictly necessary to establish and verify their nature,

characteristics and measurement, according to normal diligence, without any signs of wear or dirt, in compliance with the conditions of

following reported:

the right of withdrawal can be applied to the product purchased in its entirety; it is not possible to exercise withdrawal only on

part of the purchased product (including the accessory equipment: labels, tags, tags, seals, etc …).
As indicated in point 5.3, the shipment of the products, up to the certificate of receipt by Giannotti

Vittorio & Figli snc is under the full responsibility of the Customer. Therefore, in the event of damage to the products during

transport, Giannotti Vittorio & Figli snc will notify the Customer, so as to enable him to report promptly

towards the courier and obtaining the relative reimbursement; the product will then be made available to the Customer,

simultaneously canceling the request for withdrawal or indicating to the customer the decrease in value of the asset and of the relative

refund;
Giannotti Vittorio & Figli snc will not respond in any way for damage, theft, loss occurred during or in any case

dependence of the return shipment.

5.5 Giannotti Vittorio & Figli snc will refund the customer the full amount paid within 5 (five) days from the date of

receipt of the returned product.

5.6 Unless otherwise agreed, Giannotti Vittorio & Figli snc will reimburse the customer the full amount paid, using the same means of

payment used by the Customer. In case of payment in cash, the amount will be returned by bank transfer, using

the bank details indicated by the Customer in the Return Form. In any case, the customer will not be charged for the return.

5.7 After the return of the products, Giannotti Vittorio & Figli snc will make the necessary assessments relating to compliance

of the same under the conditions and terms indicated in this document and where the checks do not end positively,

will notify the Customer, via e-mail, of the existence of a decrease in the value of the products

returned, resulting from failure to comply with the aforementioned conditions. At the same time, Giannotti Vittorio & Figli snc will communicate

the amount that will be deducted from the refund, without prejudice to the possibility, alternatively, for the Customer to get back, at his own expense, the

products in the state in which they were returned to Giannotti Vittorio & Figli snc.

5.8 In case of forfeiture for any reason of the right of withdrawal, Giannotti Vittorio & Figli snc will return to the

sender of the product purchased, charging the shipping costs and, where already reimbursed, the price of the product.

5.9 For more information on the terms of return (including repayment terms) and the product exchange service, it is

it is possible to consult the Right of Withdrawal and Legal Warranty established by current regulations.

6. GUARANTEES
6.1 All products sold by Giannotti Vittorio & Figli snc are covered by the legal guarantee of 24 (twenty-four) months for the

lack of conformity, pursuant to Title III of the Legislative Decree 206/2005. For more information you can consult the Right to

Withdrawal and legal guarantee established by current regulations.

6.2 The guarantee for defects of conformity only operates for the products used correctly, in accordance with their purpose and standards

instructions and directions shown on the site.

8.1 The personal data collected with the forwarding of the Order will be processed by Giannotti Vittorio & Figli snc for the sale and for the

9. APPLICABLE LAW
9.1 The sales contract referred to in these Terms and its execution is governed by Italian law, with the

non-application of conflict rules and the United Nations Convention for the International Sale of Goods. For the

the resolution of the relative disputes will be settled by the Court of the municipality of residence of the Customer.

9.2 In the event of disputes arising from the Conditions, the Resolution body may also be consulted in advance

Alternative of the online dispute of the Chamber of Commerce of Naples (www.conciliacamera.it/).

9.3 Finally, the European Commission provides a platform for the alternative extra-judicial resolution of the

disputes, including cross-border disputes, accessible on the website http://ec.europa.eu/odr.

10. MODIFICATIONS AND UPDATES
10.1 These General Terms and Conditions of Sale may be amended from time to time, also following any changes

nomativi. The new General Terms and Conditions of Sale will be effective from the date of publication on the Site.
